Terms of Service
This page is a plain-language draft. A lawyer hasn’t reviewed it yet, and it may change before Kaizora launches.
These terms are the agreement between you and [legal name of the business], of [business address] (“Kaizora”, “we”), when you use the Kaizora app and website. By creating an account, you accept them.
In Short
- Your data is yours. We store it and show it to you; we don’t sell it.
- Kaizora isn’t a medical device and doesn’t give medical advice.
- What you do yourself is free, and stays free. Kaizora Plus, coming at launch, is an optional subscription you can cancel at any time.
- Don’t misuse the service or try to reach anyone else’s data.
- We work hard to keep Kaizora running and your data safe, but we can’t promise it will never fail, so keep copies of what matters.
Your Account
You need to be at least [minimum age] to use Kaizora. An account is for one person. Keep your password to yourself; you’re responsible for what’s done with your account. Tell us at [contact email] if you think someone else has used it.
Your Data
Everything you log, import, or upload stays yours. You give us permission to store it, process it, and show it back to you, only as needed to run Kaizora for you; that permission ends when you delete the data or your account. How we handle it is in the Privacy Policy.
Only import files and connect services you have the right to use, and remember that a connected service’s own terms still apply to it.
Not Medical Advice
Kaizora helps you keep track of your own data. It doesn’t diagnose, treat, or prevent any condition. Reference ranges, flags, correlations, and calculated values such as BMI are information, not advice, and they may be wrong for you. Talk to a health professional about your health, and never delay seeking care because of something Kaizora shows or doesn’t show.
Free and Kaizora Plus
Everything you do yourself in Kaizora is free: logging, every file import, unlimited history, charts, habits, reference ranges, the timeline, Home, comparing metrics, and exporting your data. Nothing free will ever move behind Plus, and viewing, editing, and exporting your data will never be paid.
Kaizora Plus adds more than one live connection at a time, Discover (the strongest correlations across all your metrics), and the AI Overview (described in the Privacy Policy).
Kaizora Plus isn’t for sale yet. The rest of this section applies once it is.
Price and Billing
- Plus costs US$8.99 a month or US$89.99 a year. Checkout can show and charge the price in your own currency, converted by Stripe, our payment processor.
- You pay in advance for each month or year. Your subscription renews automatically at the end of each period, at the price then in effect, until you cancel.
- Payments are handled by Stripe. We never see or store your full card number.
- If a payment fails, Stripe retries it. Plus continues for up to 7 days while it does; after that, it lapses until the payment goes through.
Taxes
Prices don’t include sales taxes. Where we’re required to charge GST, HST, QST, VAT, or another tax, it’s added to what you pay. [Owner to confirm: which taxes Kaizora registers for and collects, and whether prices are shown with or without them.]
The Free Trial
A new account’s first 30 days include Plus, free. We don’t ask for a card, so nothing is charged when the trial ends: Plus simply lapses, unless you’ve subscribed. If you subscribe during the trial, your trial still runs to its end, and your first payment is on the day it would have ended. There’s one trial per account.
Cancelling
You can cancel at any time in Settings: under Plan, Manage billing opens Stripe’s billing page, where you can cancel, switch between monthly and yearly, update your card, and see your invoices. Cancelling stops the next renewal. Plus stays on until the end of the period you’ve already paid for, then lapses.
Refunds
[Owner to confirm.] Proposed: payments aren’t refunded, in whole or in part, for a period you’ve started, including when you cancel or delete your account partway through it, except where the law requires a refund. The free trial lets you try Plus before you pay. If you’re charged by mistake, write to [contact email] and we’ll refund it.
Price Changes
We may change the price of Plus. We’ll tell you by email at least [30 days] before a new price applies to you, and it applies only from your next renewal after that notice. If you don’t want to pay it, cancel before then. [Owner to confirm the notice period.]
If Plus Lapses
When Plus ends, whether you cancelled, a payment failed, or the trial ended, nothing is deleted or hidden, and you keep viewing, editing, and exporting all your data. Your first live connection keeps syncing; the others pause, and catch up from where they stopped if you have Plus again within 90 days. Discover and new AI overviews stop; the last overview written for you stays readable.
Acceptable Use
Don’t:
- try to reach another person’s account or data, or test the service’s security without our written permission;
- disrupt or overload the service, or reach it by automated means other than the app;
- copy, resell, or rebuild the service, or use it for anything unlawful.
Availability and Changes
We work to keep Kaizora available, and to keep your data backed up and secure, but the service is provided as it is and as available. It may be interrupted, and features may change. Keep your own copies of anything you can’t afford to lose: you can export all your data, for free, from Settings.
If we ever shut Kaizora down, we’ll tell you at least [90 days] ahead and keep export available until then.
Liability
To the extent the law allows, Kaizora isn’t liable for indirect or consequential losses, or for decisions you make based on what the app shows, and our total liability to you is limited to what you’ve paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection law, including Quebec’s Consumer Protection Act if you live in Quebec.
Ending Your Account
You can stop using Kaizora at any time. You can delete your whole account from Settings, for free. Deleting your account deletes all your data, and cancels your Plus subscription at once, so you’re not charged again; see Refunds above for the rest of the period.
We may suspend or close an account that seriously or repeatedly breaks these terms, and we’ll tell you why unless the law prevents us. If we close your account without you having broken these terms, we’ll refund the unused part of a period you’ve paid for. [Owner to confirm.]
Changes to These Terms
We’ll post any new version here with its date, and tell you in the app before a significant change applies. If you don’t agree, you can stop using Kaizora and delete your data.
Governing Law
These terms are governed by the laws of [province] and the federal laws of Canada that apply there, and disputes go to the courts of [province], unless the consumer protection law where you live gives you the right to go to your own courts. [Owner to confirm jurisdiction and governing law.]
